Terms of Service

1. Acceptance of Terms

By creating an account or using Pickup ("the Service"), operated by Pickup Technologies ("we", "us", or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service. These Terms apply to all users, including businesses and individuals who access or use Pickup in any capacity.

2. Description of Service

Pickup is an AI-powered phone receptionist platform designed for trades businesses in Canada. The Service answers inbound calls on behalf of your business, qualifies leads, books appointments into connected calendars, sends SMS and email notifications, and provides a dashboard with call transcripts, recordings, and analytics.

We reserve the right to modify, suspend, or discontinue any part of the Service at any time. We will provide reasonable notice of material changes where possible.

3. Account Registration

You must create an account to use Pickup. You agree to:

  • Provide accurate, complete, and current information during registration
  • Maintain the security of your account credentials
  • Notify us immediately of any unauthorized access to your account
  • Be responsible for all activity that occurs under your account

You must be at least 18 years of age and have the legal authority to enter into these Terms on behalf of yourself or the business you represent.

4. Subscription and Billing

4.1 Free Trial

New accounts receive a 14-day free trial. A credit card is required to start. At the end of the trial period, your account will require a paid subscription to continue using the Service.

4.2 Subscription Fees

Pickup Pro is priced at $249 CAD per month. Fees are billed in Canadian dollars. All amounts are exclusive of applicable taxes (including GST/HST), which will be added where required by law.

4.3 Billing and Renewal

Your subscription renews automatically on a monthly basis. You authorize us to charge your payment method on file on each renewal date. Failed payments may result in suspension of your account. We use Stripe to process all payments; your full payment details are never stored on our servers.

4.4 Cancellation

You may cancel your subscription at any time through your account settings or by contacting us at hello@use-pick-up.com. Cancellation takes effect at the end of the current billing period. We do not provide refunds for partial months.

4.5 Price Changes

We may change our subscription pricing with at least 30 days' written notice. Your continued use of the Service after the effective date of a price change constitutes acceptance of the new pricing.

5. Acceptable Use

You agree not to use Pickup to:

  • Violate any applicable laws or regulations, including Canadian telecommunications law (CRTC regulations) and CASL
  • Deceive callers as to the nature of the AI-automated service in a materially harmful way
  • Record calls in jurisdictions where consent is required without obtaining proper consent
  • Harass, spam, or abuse callers or any third parties
  • Engage in any fraudulent, misleading, or illegal business practices
  • Attempt to reverse-engineer, copy, or resell any part of the Service
  • Circumvent or interfere with the Service's security or integrity

We reserve the right to terminate accounts found in violation of this section without refund.

6. Call Recording and Consent

Pickup records phone calls as part of its core functionality. You are solely responsible for ensuring that call recording complies with all applicable laws in your jurisdiction, including obtaining any required consent from callers. Canadian privacy law generally requires that callers be informed when a call is being recorded; you should confirm the specific requirements for your province and any cross-border calls.

Pickup's AI receptionist announces that the call may be recorded at the start of every call. You are responsible for ensuring your agent greeting retains this disclosure and for obtaining any additional consent your circumstances require.

7. Third-Party Services

Pickup integrates with third-party services to deliver its functionality, including Twilio (phone/SMS), Vapi (AI conversation), Stripe (payments), Google Calendar, Supabase (database infrastructure), Resend (email), and Clerk (authentication). Your use of the Service is also subject to the applicable terms and privacy policies of these providers. We are not responsible for the actions or content of third-party services.

8. Intellectual Property

All rights, title, and interest in and to the Service (excluding your content) are owned by Pickup Technologies. You are granted a limited, non-exclusive, non-transferable licence to use the Service during your subscription period for your internal business purposes.

You retain ownership of your business data, call recordings, and transcripts. By using the Service, you grant us a limited licence to process and store your data as necessary to provide the Service.

9. Service Availability and Disclaimer

We strive to maintain high availability but do not guarantee uninterrupted, error-free service. The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including fitness for a particular purpose or merchantability.

AI-generated call summaries, lead qualifications, and transcripts are produced automatically and may contain errors. You are responsible for reviewing and verifying any AI-generated content before acting on it.

10. Limitation of Liability

To the maximum extent permitted by applicable law, Pickup Technologies and its affiliates, officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, lost revenue, loss of data, or business interruption, arising out of or in connection with your use of the Service, even if we have been advised of the possibility of such damages.

Our total aggregate liability to you for any claim arising from these Terms or the Service shall not exceed the total amount you paid to us in the three months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless Pickup Technologies from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.

12. Termination

Either party may terminate the agreement at any time. We may terminate or suspend your access immediately if you violate these Terms, fail to pay fees, or if we determine in our sole discretion that your use of the Service creates legal or operational risk. Upon termination, your right to use the Service ceases immediately. We will retain your data for 90 days after termination before permanent deletion, during which you may request an export.

13. Governing Law and Dispute Resolution

These Terms are governed by the laws of the Province of Alberta and the federal laws of Canada applicable therein, without regard to conflict of law provisions. You agree to submit to the exclusive jurisdiction of the courts located in Calgary, Alberta for any disputes arising from these Terms or the Service.

14. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by email or through the Service at least 14 days before the changes take effect. Your continued use of the Service after the effective date constitutes acceptance of the revised Terms.
